Guys:

The copyright laws are far from being 100% clear, and it appears much of what is a violation is determined by the courts. What violates is based on these four factors.

"Section 107 contains a list of the various purposes for which the reproduction of a particular work may be considered “fair,” such as criticism, comment, news reporting, teaching, scholarship, and research. Section 107 also sets out four factors to be considered in determining whether or not a particular use is fair:

1. the purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes;
2. the nature of the copyrighted work;
3. amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
4. the effect of the use upon the potential market for or value of the copyrighted work.

Copyright law has alway been an interest of mine--more of curiosity than anything. I'm not a lawyer, but it looks like four factors can really me read in various ways.

I concurr WRT the skill and artistry of the Moosejaw tub diver set.

Mark's use of Bulgarians, in this case, was due to financial concerns. As members of the International Tub Divers Union, the MJ crew demand top $$$.

The Bulgarians on the other hand can be had for a pitance. They have no real medical plan, their dental benefits are a joke and they get paid straight time for any OT they put in. Whats more, you can sleep them six to a room (think ASLOK levels of BO but with more paprika) and they will all fit easily into the trunk of your average vehicle for travel purposes.

I also hear that Mark can write off the money spent on the Bulgarians. He can claim them as dependants and list them as foreign research students.

Anyway, I still believe that that is Tater over in the back behind the furry bald guy.

I had not thought about the financial angle. For my money, the best bang for the buck comes from Lithuanian tub divers. I bet you did not know this, but we have another top-notch diver hidden amongst us. I am not at liberty to divulge his identity, but he is a very "Jazzy" sort of fellow. Hardly an "itinerant intellectual" make no mistake, but when it comes to pure athleticism, there is no better tub diver around these parts. -- jim

PS: For my money, I don't think Tate has it in him to do a real good tub-dive. I think he is too uptight to have the flexibility necessary to enter the tub without spilling the counters onto the floor. As you know, the judges take off for splashing counters.

Lately, I've been on the USMA CMH (Center For Military History) site and reading the accounts of US Congressional Medal of Honor recipiants, was thinking of expanding my reading to VC's. This is a great place to start.

Schwerpunct has some scenarios on Medal of Honor winners as well as VC recipients. One of them involves Upham. That man was tough as nails.

I've been to Iraq a couple of times, picked up dismembered body parts, seen and been in one or more situations that I would not expirence more than once...BUT PLEASE, the mental picture of Mark IN A THONG! It is topics like this that should be best left to another forum, LET THE PROFESSIONALS DEAL WITH THIS! Threads of this nature can only be counter-productive to the entire hobby and this forum, and could litterally scar a person and leave long lasting psychological marks.

Stick close to one of the veterans and do what he does. You get used to this sort of thing after a while and yes, the nightmares do go away.

Ahh yes, the Lithuanians. Since the Wall went down you don't hear much from them anymore ... mind you, even with the wall up they were pretty quiet.

I think that you're both underestimating the influence of the recent influx of a significant number of Finnish competitors in the sport. While they cannot compete with the Bulgarians in the team events, they have proven quite skilled in the individual disciplines.

You need look no further than Heinonen's incredible double back-flip with knotted thong at last year's world championships to see how they have mastered the skills of the sport at the highest level. That extended butt-clench to keep every counter in the tub was something I'll know I'll be watching time after time on the highlight video.

Heinonen's double was over-ratted. The Finn's bribed the French judge and plied the Austrian judge with pork. I know most people are not up to the task, but if you look at the replay, you will see the knot is not even truly uncomfortable. I will grant that there are an awful lot of Finns showing up in the circuit of late though. They are getting much better for sure. -- jim

Yes, the "butt-clench". Worth at least a tenth of the divers total point score. Remember when the ITDF introduced those plastic coated counters? The thought being that the coating would prolong the useful life of tub counters, creating significant savings over the long term. The tubs became too fast although the slick surface did provide some spectacular moves. However, combined with the increasing skill of the Divers, the incidence of injuries rose significantly. It was determined that the plastic coating was at fault for this. Now that they've gone back to "Classic Tub Diving" the injury rate has dropped and more of the old moves have returned to the sport. Who can forget the Triple Tuck Spin of Russia's Anatoly Zutsov. He suffered a nasty counter impact friction burn from that one but it was worth it as he took the Gold that year in Sofia.

Indeed, for the sake of a few soiled counters, 'Classic' is the way to go and Mark is a master of the 'Classic' style.
