Realizing that this is a variant of a current question, I'm still going to ask it.

HERE"s the situation...

I have a tank firing SMOKE at the 2nd level of a bldg. It does NOT Have a LOS to the ground level. At the ground level of the bldg in question, is a concealed unit.
Do I have to pay the case K +2 TH DRM?
I say NO-b/c upon reading C6.2 and it's definition of a KNOWN unit.
But I note what the other thread on this same topic says.

So, who's right?

Yes, per C6.2. The hex contains an enemy ground unit that is not Known to the firer.
I agree. Remember - AREA target type is against the whold hex and not just a location. Any unknown unit (whether concealed or out of LOS) in the hex counts for Case K. The exception in C6.2 allows the inclusion of an out of sight non-concealed unit when considering Case K.

But what if....

What if there was a HIP unit at the ground level?

Then the defender would have to reveal the HIP to get the +2 Case K drm, right?
