VBM freeze rule ?/confirmation

Per the example in A7.212, am I reading this right re VBM freeze of a multi-story building hex?: If a squad is in an UPPER LEVEL being VBM "freezed" by a BU CT AFV the squad is eligible to fire outside the hex because it's a different Location, right?

What if the AFV happened to be CE? Would it be restricted from firing out of the hex?

The critical distinction when not in the same location is whether the unit can use TBPF.

A7.212 Whenever a unit is eligible for TPBF vs Known enemy units, it can attack only those units. Spotters (C9.3) are similarly limited, but Observers (C1.6) are not.
Once the HT and the squad are in different locations, they are restricted to the same location or the TPBF location only so long as a TBPF opporunity exists. See A7.211 for the TPBF against PRC.

Almost. It is because they are in a different location and not eligible for a TPBF.

A7.211 Any PRC not BU in a CT AFV which are in an enemy-occupied hex are subject to TPBF attacks from enemy units in that Location or any higher Location in that hex, regardless of whether or not the PRC disembark (see also D6.5).
So right. The personnel unit is restricted because of the TPBF opportunity.
