I would say Yes .......

in A20.5 GUARDS & UNARMED UNITS: A Personnel unit is captured as (i.e., exchanged for) a white unarmed counter of the appropriate size, and is placed above the unit that captured it (captor's choice if more than one capturing unit).

The Prisoner is not "moving" nor "advancing" into the hex as part of the surrender process, so wouldn't be violating the Fortified Bldg rule preventing such movement.

Out of curiosity, why would one think they would not?
I could see why it would be asked. Infantry cannot move into a Fortified location that has an unpinned enemy squad equivalent...... Prisoners are Infantry.... etc and so forth

Isn't this kind of 'special passage' the same for Minefields? I.e. IIRC units surrendering are not attacked by Mines while leaving a Minefield.
