Prisoner capturing the Guard

A broken Russian squad that is guarding a German prisoner squad is forced to route because it is ADJACENT to a AFV in motion.
Unfortunately for the Russian Guard it has no where to route, as all paths are closer to the enemy. Does the Russian unit just die for failure to route - creating a Newly minted German Conscript
OR
Does the German ex-prisoner because a new Conscript that is now required to either take the Russian prisoner or commit Card Board War crimes and invoke No Quarter

A capturing unit has to be armed and Good Order [A20.21]. A prisoner is neither. The broken guard is eliminated for failure to rout, and the former prisoner re-arms.

It depends if the POW was a SMC or not (A20.551 & A10.5). If the escaped POW was a SMC he would have to take the now broken guard POW or reject its surrender thus invoking No Quarter.

Even a SMC is still a prisoner until the guard is eliminated, and so is not Good Order. In order to take a prisoner the capturing unit has to be Good Order.

First off thank you for the clarification:
"In order to take a prisoner the capturing unit has to be Good Order." The is true when looking at Rtph captures.
But the rule book does seem let prisoners capture thier guards during the CC phase

If the broken guard was in Melee (marked with a Melee counter), it would not have to Rout and would not be eliminated for Failure to Rout [A11.16]. If the broken guard was not in Melee, it would be eliminated for Failure to Rout during the RtPh and would no longer exist when the CCPh began. Your question seemed to be about elimination in the RtPh, so I naturally assumed there was no active Melee. Was there an active Melee?

I fully see now after reading the Gospell- I was just making the point that the prisoner could attempt to capture its guard but only during an existing melee with said guard.
