Primosole scenario J97 question

In scenario J97, the Germans get two hip units and two hip guns.

SSR#4 says the British place 8 shellhole counters in any hexes which can have shellholes and don't contain German units. What if the British picks one of the hexes with hip units. Is it freecon?

I thought I had seen a Q&A on this before but could not find it. In the absence of anything to the contrary, I would quietly accept that the Brits have enhanced by position by giving me more TEM.
