OBA - Voluntary or not Voluntary Loss Contact

Hi,
situation:
during the DFPh the German maintains radio contact and access to the OBA battery is ok.
The next Turn, PFPh does not try to maintain radio contact (to make the move afterwards).
Next Phase (MPh), He move but also having Your SR in LOS (see image).
Is this considered a voluntary loss of contact?
Reading the final part of rule C1.22 and Spilky's help table 20a, it does not seem to be considered voluntary.
ps. is especially important for maintaining access to the OBA battery.

If the Observer has a LOS to the SR in the PFPh, then choosing to not roll for Radio Contact/Maintenance is not considered voluntary.

C1.22:
"...However, failing to roll for Contact/Maintenance is considered voluntary loss of Contact only if the Observer has no LOS to the SR’s/FFE’s Blast Height (1.32)..."
