Hi,

its the enemy defensive fire phase, I have a concealed enemy unit that has a friendly target to fire upon, however, it's command DR is a 2,2 causing panic and thus marked with a panic marker.

Does the unit loose it's concealment status, the consequences of panic say that it considered to have final fired but as it has not physically fired does it loose concealment?

This is an interesting question, I don't think I've ever looked at it that way before. I suspect (and have always played as though) the last sentence of 6.211 "Panic does not cause loss of concealment." trumps the final fired clause wrt concealment. For what it's worth you are instructed in 6.212 that the unit is "assumed to be under..." but you don't actually place a marker, which might imply that it isn't actually firing but simply reinforces the fact that if it is compelled to by an ADJACENT foe it's fire is halved and other final fire penalties are in effect.

I have played it that it would not lose its concealment status. But I tend to give the ENEMY more leeway and more help even at the cost against me.

Thing is, retaining concealment during panic helps the player more than the enemy, since panic occurs to the FRIENDLY side more than the ENEMY and the player is usually more savvy about using/being/causing loss of concealment than the ENEMY, given the action table results.
