Per B9.21 which George has quoted, having LOS seems to be the only requirement, not declaring a shot.
This would be perfect, but by SSR the trench in my original illustration is HIP, but the unit in the trench is not HIP, but is also not in LOS.

Maybe I'm being dense, but that would mean that my opponent is also dense. He's not.

Neither Bocage in itself nor the Open Ground behind it is Concealment Terrain. Yet you still may set up your Trench HIP.

But as we don't have Night or PTO here, the Fortification would lose HIP when in enemy LOS, I suppose. And we have learned that the Trench is in LOS as per B9.21.

Coming back to this as I see the same issue in Crossing the Moro.

In Moro units entrenched behind vineyards are considered out of los to same level units.

And, once again entrenchments are HIP until used, so my opponent can think he has a Los to my unit, but actually he does not as the FH blocks LOS.

So schrodinger's entrenchment again.

Perhaps I'm not explaining myself correctly.
