Is it legal to have a stack of 3 ? counters and then split off one of them and thus have 2 stacks of 2 ? counters?

yes, it is. Imagine if you have a concealed stack of 2 MMC and you advance one of them into a woods hex. You gain another ? counter.

Sneaky but legal

But you won't be able to split the two stacks of a unit + a concealment counter.
So there is a limit.

It is a concealment loss activity (in LOS of a good order enemy unit) and you would also need a leader (EXC Finn).

Four ? in the OOB stacked looks like a SMC, SW, and MMC or just a big stack of dummies. They can split up into three 2x? counters or three ?+a real unit ... Then mix them with other concealed stacks (deleting one ? as you do) and then resplit (adding one ? as you do) to see which cup holds the pea.
