C3.33 AREA TARGET TYPE and friendly units

Google has told me I understand this correctly (now), but I have seen it played differently so many times I need confirmation.

Situation:
A berserk Russian unit moves into a hex occupied by a German unit during the MPh. Both are still in the hex for the DFPh. A German mortar targets that hex. Assuming a hit with an effect, does the effect apply to both the Russian and German unit?

I believe the answer is "YES".

Per A7.4 & C3.33, Area Target Type vs enemy units when friendly units are present is allowed and will attack those friendly units.

C3.33 AREA TARGET TYPE: The Area Target Type must be used at all times by mortars and whenever ordnance [EXC: LATW] attempts to fire SMOKE; otherwise it may be selected when firing HE (but not AP/HEAT HE Equivalency; 8.31). All (including friendly) non-Aerial units in the target hex can be hit (even by WP), except for those immune as per 3.4....
I do wish they would explicitly list just when friendly units can be hit....like maybe a list of exceptions to A7.1?

The list as I see it is:
- shooting into melee (A11.15)
- OBA (C1.5)
- C3.33

Any others?

A7.4 adds prisoners. It's not exactly clear that a prisoner is a friendly *unit* as it can't move by itself, but whatever.
