gunflashes and freedom of movement

Situation: at night, a cloaking counter containing 2 MMC and a SMC moves into an 8 factor AP minefield. the minefield attack result is a MC causing one MMC to break. This creates a gunflash in the hex which is observed by a NO MOVE defending stack (3 MMC 1 SMC ). Do the defending units gain freedom of movement? are they allowed to fire at the gunflash hex.

A gunflash does not give FoM. If the now-broken unit is in NVR, that would grant FoM. This event might draw a starshell (allowed during the MPh either from a leader or because the initial starshell had not yet been placed). The starshell would illuminate the broken unit, which would grant FoM.

Units may fire at a gunflash location beyond NVR but treat the targets as concealed even if they are not [E1.81].

For that matter, the MC, if in NVR or iluminated by a starshell, nearby blaze or IR, would be enough to strip the cloaking and pop the no move counter, so long as someone is willing to temporarily reveal to do it. If it happened in a hex beyond NVR, non-iluminated, then no, not good enough, as JR says above. Just figured I would expand on his answer a bit.

30 something years later and I still don't understand the night rules !?!? Let me know when you figure them out !!!!!
Nite rulz simplified:

  1. Guy runs up adjacent to you.
  2. You can't shoot because with poor starshell placement you blinded yourself
  3. You can't get yourself off no move neither
  4. You can't even strip concealment when he fires at you in the AFPh
  5. You can't voluntary break because you don't have LOS
  6. He advances in (still not losing concealment), ambushes you (he only needs to roll two less than you anyway), kills you dead and generates a leader
  7. Repeat
